What You Need to Know About Paternity Law

Establishing Paternity Matters

Paternity doesn’t just establish legal rights and responsibility, like custody, visitation and financial support. It also gives children the access to both parents they need for emotional and financial stability.

Rights & Responsibilities

  • Custody
  • Visitation
  • Decision-Making Authority
  • Child Support

Without a court-recognized paternity order, the mother of a child born out of wedlock has custody of the child until determined otherwise by a court of competent jurisdiction. Once paternity is properly established by working with Stark Law, both parents can seek fair parenting time, decision-making authority and financial contributions.

Common Paternity Situations We Handle

Mothers: Seeking to establish paternity for child support.

Fathers: Denied access to their child.

Disputes: Over visitation or enforcement of orders.

DNA Testing: And denial-of-paternity cases.

Your Legal Options for Establishing Paternity and Protecting Your Rights

How Paternity Is Established in Oklahoma

There are a few different ways to legally establish paternity under Oklahoma law. The right choice for your family depends on the whether the parties involve agree, and if they are willing to work together:

Voluntary Acknowledgment

These can require extra planning, bureaucratic work and logistics. Court proceedings can also be delayed if a service member is deployed or on active duty.

Court-Ordered Testing

DNA testing is carried out when paternity is denied or disputed.

District Court Orders

These are used to adjudicate the father and establish custody, visitation and support. Hospital documents aren’t sufficient.

DHS Involvement

If state assistance is provided, the Department of Human Services (DHS) may pursue paternity.

Custody, Visitation & Child Support After Paternity

Once paternity is legally established, Stark Law will help you secure enforceable court orders:

Custody

Joint or sole custody decisions are based on the best interest of the child.

Visitation

Creation of structured schedules based on paternity and other factors.

Child Support

Determined using Oklahoma’s income-based formula, factoring in gross income, visitation, childcare, healthcare and shared expenses.

How Paternity Cases Become Complicated

Though paternity seems like a simple matter, there are some circumstances which can complicate paternity cases and require different levels of intervention:

Denied or Disputed Paternity: DNA testing and court petitions to confirm or refute biological parentage.

Withholding a Child: Legal steps when one parent refuses visitation after filing.

Endangered Child: Emergency custody actions when the child faces imminent irreparable harm or unsafe conditions.

Custody, Visitation or Support Changes: Modification of orders after a final paternity order.

Military or Out-of-State Cases: Handling jurisdiction and service-member challenges.

Parent Coordination: In high-conflict cases, mediation or parent coordinators may be required to resolve disputes.

How Much Does a Paternity Lawyer Cost in Oklahoma?

Paternity attorney costs range widely, and depend on two primary factors:

  1. The attorney’s hourly rate
  2. How much time that attorney will need to spend on your case

Many other firms will try to hide this information from you, but at Stark Law, we believe knowledge is power. Our hourly rate is $250 per hour, and paternity representation begins with a $2,000 retainer. From that retainer, we will deduct the time that is spent on your case. You’ll always know where your money is going and you’ll never pay for unnecessary delays. Should the retainer run out, you’ll be billed for additional costs.

02

How do you establish paternity in Oklahoma?

Paternity can be established by either voluntarily signing an Acknowledgment of Paternity at the hospital, or later or through court-ordered DNA testing if paternity is disputed. For unmarried parents, the mother of a child born out of wedlock has custody of the child until determined otherwise by a court of competent jurisdiction. Once established, paternity sets up rights for custody, visitation and support. Stark Law can help you through the process, whether you're the mother, father or neither.

03

What rights do unmarried fathers have in Oklahoma?

Unmarried fathers have no automatic rights to custody or visitation until paternity is established. At that point, fathers can seek joint custody, parenting time and decision-making rights on the child's behalf. Oklahoma courts prioritize the child's best interests, so demonstrating involvement is beneficial.

04

How do you contest a paternity order in OK?

To contest paternity, we first file a motion in district court within a reasonable time, often requesting DNA testing to disprove biological ties. If fraud or mistake is proven, the court may set aside the order, but it's limited to two years unless special circumstances apply. Any child support paid in the meantime may need repayment. This is a complicated process which needs to be addressed appropriately, but Stark Law will be by your side to handle challenges efficiently.

05

What is the paternity and child support process in Oklahoma?

After establishing paternity through acknowledgment or court order, child support is determined in accordance with Oklahoma's child support guidelines. This includes both parents' gross earnings, visitation, childcare expenses, health costs, and other factors. We will file for support through the district court. If the child is receiving state assistance DHS may be a necessary party. Orders can include retroactive support. When you work with Stark Law, we will ensure fair calculations and enforcement.
