What You Need to Know About Divorce in Oklahoma

In Oklahoma, divorce law is governed by state statute, but outcomes of each case hinge on your unique, real-life details: your assets, your children, your timeline and your goals.

IMPORTANT: Temporary Orders and Emergency Custody

The first major step in a divorce is a “Temporary Orders Hearing”. This hearing occurs within 30 days of initial filing, and if domestic violence is alleged, the hearing will be held within 10 days of initial filing. This is where the judge will set ground rules for finances, housing, custody and visitation during the case. These orders are almost never changed during the pendency of the case until a final order is issued, so you need legal representation during this phase to ensure a favorable outcome!

Residency & Filing Requirements

At least one spouse must have lived in Oklahoma for six months and in the filing county for at least 30 days.

10-Day & 90-Day Rules

Divorces without minor children can finalize in as little as ten days. When children are involved, a mandatory 90-day waiting period applies.

Co-Parenting Course Requirement

Parents with minor children must complete a state-approved co-parenting course before the decree is issued. We’ll help you choose an approved provider and file proof of completion.

No-Fault Divorce

Oklahoma doesn’t require one party in a divorce to be “at-fault”. You don’t have to prove any wrongdoing – simple incompatibility is considered grounds for divorce.

Pregnancy Limitation

Oklahoma state law prohibits divorce while the wife is pregnant. In cases involving abuse or safety concerns, we pursue immediate protective and temporary orders until the case can proceed.

Common Issues We Handle

There are a lot of moving parts to consider during a divorce – from finances and work schedules to the needs of the children, assets, account access and more. But don’t worry. We’ve done this for years and will address each concern directly, ensuring nothing slips through the cracks.

Property and Debt Division

Oklahoma is an equitable distribution state, which means fair but not always equal division. We identify marital vs. separate property and pursue a balanced outcome.

Alimony and Spousal Support

These are determined by the court based on need, ability to pay, marriage length and many other factors

Child Custody and Visitation

Custody and visitation can be a contentious topic, but Stark Law is well-versed in handling these issues.

Child Support

Child support guidelines are calculated based on income, overnight visits, childcare costs and many other considerations. We can help you estimate what the court ordered support will be.

Emergency and Contempt Hearings

The truth is that divorce can get very messy. If safety for you or the child becomes an issue, we can approach the court and request emergency relief. This is one of many ways we can empower you and protect you and your children during proceedings. If an existing order is violated by your spouse, we will pursue contempt charges to quickly enforce the court order and make them change their behavior.

Military Divorces

Military families face additional considerations under the Servicemembers Civil Relief Act (SCRA) and the Uniformed Services Former Spouses’ Protection Act (USFSPA). At Stark Law, we’re highly experienced in how deployments, pensions and DFAS regulations affect divorce timelines and property division. You need an attorney who is well-versed in military divorces.

You Need a Divorce Lawyer

You may be tempted to try and handle a divorce on your own, but the truth is you’re going to need help. The future of your family, your relationship with your children, your finances and your ability to provide for your family can all hinge on very small, seemingly trivial aspects of divorce proceedings. Overlooking one document, missing deadlines or failing to understand what the court is looking for can lead to devastating consequences.

01

How Much Does a Divorce Lawyer Cost in Oklahoma?

Divorce attorney costs range widely, and depend on two primary factors:

  1. The attorney’s hourly rate
  2. How much time that attorney will need to spend on your case

Many other firms will try to hide this information from you, but at Stark Law, we believe knowledge is power. Our hourly rate is $250 per hour, and divorce representation begins with a $2,000 retainer. From that retainer, we will deduct the time that is spent on your case. You’ll always know where your money is going and you’ll never pay for unnecessary delays. Should the retainer run out, you’ll be billed for additional costs.

02

How long does divorce take in Oklahoma?

Without minor children, divorces can be finalized in as little as 10 days. However, if children are involved, a mandatory 90-day waiting period applies before the divorce can be finalized. Realistic timelines vary widely and hinge on the complexity of your case and whether your divorce is contested or uncontested.

03

What are grounds for divorce in Oklahoma?

Oklahoma allows both no-fault and fault-based grounds for divorce. The most common ground is incompatibility, meaning the marriage cannot be saved. Fault grounds include abandonment, adultery, cruelty, imprisonment and others. However, you do not need to prove fault to get a divorce.

04

How do you file for uncontested divorce in OKC?

To file for an uncontested divorce, one spouse files a Petition for Dissolution of Marriage stating incompatibility as the reason. Both spouses must agree on issues such as child custody, spousal support and the division of assets. After filing the required forms and paying the fees, the court will review and finalize the divorce after the waiting period.

05

Can you get divorced while the wife is pregnant in Oklahoma?

No, it is against state statute for a judge to grant a divorce if the wife is pregnant.

06

What are divorce filing fees in Oklahoma?

Filing fees vary by county, but usually range between $150 and $300. In Oklahoma County, the fee for divorce with minor children is approximately $250. Additional costs may include attorney fees, mediation and court services.

07

What is the divorce process with children in Oklahoma?

When minor children are involved, you must complete a state-approved co-parenting course and wait 90 days after filing before the divorce is granted. Temporary orders may set custody and support during this period. The court focuses on the best interests of the child throughout the process.

08

How much does a divorce attorney cost in OKC?

Attorney fees range widely, generally from $200 to $400 per hour, depending on the complexity of the case. Contested divorces are more expensive, often costing thousands, while uncontested divorces are more affordable. At Stark, we offer transparent billing and competitive rates.
